quota-reservation_HxgHN_65Our honorable Chief Justice is never out of news. First it was his infamous remark “CJI is not a public servant but a constitutional authority and thus out of RTI’s purview”, this time around he has vacated Calcutta HC’s stay on PG Quota. His judgment of the same case made for an interesting read.

Justice Balakrishnan who headed the Constitution bench on the OBC quota matter,said earlier matriculation was the benchmark was the benchmark for determining the SEBCs (Socially and economically bacward class) which has now gone up to graduation. Now the point is that even if one concedes to the reservation policy as a means of upliftment of the people who have had a history of being denied equal status and growth opportunities in our society, one cannot close his eyes to the almost no result of the reservation policy. A superficial view may take you look at a handful of people belonging to these classes drawing benefits from such a scheme but the ground reality is that those who need such policy the most have little knowledge of it, keep apart the benefit they would derive out of it. So what the CJ said, in effect translates to the fact that instead of a positive effect of the policy it has made the matter worse. In simple terms,People who needed the reservation till the level of graduation now need the benefit at the postgraduate level too. Not just there is reservation for them in the field of education alone they avail of the same privilege in jobs, promotion. In such a situation one tends to see reservation more as a problem and less as a solution. For the justice meted out the backward classes is an injustice for the other people. This i guess is a grave problem for it will turn out to be a vicious circle with no end.

I am strictly against caste based reservations and i have some logic in support of my firm stand on the issue. Firstly nobody would deny the fact that with the changing times one needs to look at these concerns in view of the realities of the present world. Today the emphasis is on talent and merit rather than anything else. As citizens of the global world one needs to look beyond the ever so narrow distinctions of religion, caste and creed. India cannot afford to lag behind in this world of cut throat competition embracing the excuse of reservation. Secondly, the social exclusion and exploitation the backward classes faced was in the ancient Indian society. These days as far as i now we don’t live in a society where the Hindu hierarchy is divided into four Varnas namely Kshatriya, brahmin, vaishya and shoodra. There has to be no reservation for the backward classes as the society has no reservations against them, atleast this holds true of urban India.

On the other hand i feel there is a strong need for reservation for the havenots in the society. Caste is no longer an indicator of social status but money is. For people with lack of resources are seen as outcast in the society. If we want a spirit of fair competition to prevail, both the competitors X and Y need to be at the same level with the equal resources at each end.

As far as the Arjun Singh’s rhetoric or reservation goes it has just one explanation that Congress will leave no stone unturned cashing on it in view of the upcoming elections. The government’s mindless reservation policy can be assessed by the fact that after more than 50 years that reservation has been put in place there have been no efforts to evaluate its result. This is nothing but vote bank politics, Congress is pro at. We must not let petty politics and poor logic behind the caste based reservation let pass with our passive attitude. We need to ask them,On what basis is the government going ahead with the new reservation scheme for the OBCs when the result of the reservation policies in the past has not been evaluated till now?We need to question those who rule us for it we who have given them this reservation.

Why should reservation be scarped? It should not be scrapped as long there is still prevalent of caste system in our society.

Viewed so, I must disclose that I don’t belong to either OBC or SC or ST. I am simply a Brahmin.

Although, I don’t have caste feeling, most of Brahmins still have caste feeling in their attitudes. Considering this, I must welcome reservation for the OBCs in the higher educational institutions.

Whether or not the quota system should be introduced or not, has been debated for ages. What is evident from the debate over the years is that it simply leads us to the same old gold question.... which came first, the egg or the chicken !

Though we are back to square one with the Quota issue, atleast the supreme court has made an effort to enforce quota with the economic background as the decider. Imho, we should quickly move to a system where the entire Indian population, irrespective of caste or creed should have reservation, strictly based on ”Economic backwardness”. this is the best way to bridge the gap between the haves and have-nots.

Instead of focussing on primary education the entire focus is on higher education. Only a section of the reserved category will benefit from the quota system while the condition of the majority will remain as it is. Caste-based quota system will only aggravate caste hatred in India. If a graduate person is considered educationally backward only because he/she comes from a backward caste and qualifies for PG studies quota then no one can save this country from depleting its talent pool.

Caste-based quota system is sure to ruin the talent pool of the country. This vote-focused, narrow-minded political initiative will only aggrevate hatred among different sections of the society. Those who are already enjoying the benefits of reservation from primary education to jobs to promotion, will continue to enjoy the fruits of this reservation policy too.

Quota system upto higher secondary school is logical as we have historical evidence of deprival of equal rights to people beloning to few castes.
If someone enters graduation level, he/she is mentally, socially, psychologically ready to take on the world. He/she at that level needs determination and hardwork, certianly don’t require any cushioning to scale up in life.

There has to be fair competition at some level and a mechanism for recognising and rewarding meritorous talent. Quota system at post graduation level is a grave step, which will amount to ruining the meritorious talent in India.

When already IT and ITES sectors are lamenting about short-of-talent, bringing quota system in IITs and IIMs will certainly have its impact in the long run.

Shivangi has also touched an important issue of constitutional authorities in India. These constitutional authorities are prone to run wild when they are in power as they enjoy the constitutional protective umbrella and only impeachment by the parliament,an extremely difficult exercise, can unseat them.

We are aware of the case of the ’rogue’ T.N. Seshan who was the Cabinet Secretary and did not hesitate to bow before Rajiv Gandhi, the then Prime Minister in public. As soon as he became the Chief Election Commissioner, his antics knew no bounds. He made umpteen attempts to present himself as a saint and that too at the cost of the public exchequer. After his superannuation, he begged the Shiv Sena chief for a Rajya Sabha berth. On denial,he embarked the bandwagons of the Congress to contest against LK Advani.

Then is the infamous case of T.N. Chaturvedi,an IAS officer who made his name by exposing the Bofars scandal but did not lag behind to join the BJP to enter in the parliament. Then he became the Governor of Karnataka. When the BJP government was replaced by the UPA Government, this gentleman succeeded in retaining his job till he retired. In the meantime, he did not leave the Indian Institute of Public Administration which he considered his baby. It is altogether a different matter that this prestigious oreganisation has reached to its nadir during the days when Mr. Chaturvedi is at the helm of affairs.

There are umpteen cases of the retired judges of the Supreme Court and the High Courts heading a number of judicial commissions in the country, just by placating the politicians in power. The Ayodhya/Babri Mosque Commission has yet to conclude its findings even after a lapse of 15 years, because the Allahabad High Court judge heading it enjoys all the perks and salary which he used to get at the time of his superannuation. All these retired judges are privileged in this respect.

What B.R Ambedkar had proposed was for 30 years.We are long past those 30 years, yet the Quota system is still on full throttle. If there is a caste system, that is more because of the economic disparity. The quota system should strictly be on the basis of economic conditions. We fail to administer the fact that while enforcing the quota system, we are actually further deepening the caste segregation. There is resentment amongst the masses and that sees face on the SC/ST/OBCs.
